General rental conditions

The “Equipment rental” service is provided by ABER BIKES, (hereinafter referred to as the rental company). The rental conditions are an integral part of the rental contract. By accepting the general conditions, the lessee confirms having read and fully accepted the rental conditions.

1. Hardware Support
The lessee takes charge of the equipment in good working order. He is required to make any complaints to the rental company when picking up the equipment.

2. Return of material
The lessee is required to return the equipment to the lessor at the end of the rental period defined in the rental contract and during opening hours. The equipment as well as all accessories made available by the rental company (helmets, etc.) must be returned to the rental company in impeccable condition. If the lessee has lost or damaged accessories, they will be billed for them. Property damage is billed at published rates.

3. Extension of the rental period
An extension of the rental contract is only possible with the consent of the lessor before the end of the current rental contract. The lessor may refuse this extension without stating any reason.

4. Minimum age of policyholder
The policyholder must be of legal age.

5. Services and prices
The valid prices are those published by the rental company and in its prospectuses.

6. Breakage/Theft Guarantee
The breakage/theft guarantee is integrated into each rental, the lessee being in this case protected against breakage, whether partial or total, theft by assault, break-in or when the bicycle is attached to a fixed point. An excess of 10% of the repair bill with a minimum of €10 will remain the responsibility of the lessee in the event of breakage and an excess of 10% of the value of the cycle will remain the responsibility of the lessee in the event of irreparable breakage or flight. Please note, the guarantee does not in any way exempt the customer from carrying out the steps incumbent upon them such as: filing a complaint, carrying out a sworn declaration or communicating any supporting evidence which may be requested by the insurer as part of the disaster management and resolution.

7. Helmets
An approved helmet is provided free of charge.

8. Liability of the lessee
The lessee undertakes to use the rented equipment with caution, without danger to third parties and in accordance with the attached safety instructions. The lessee is always responsible for bodily injury and material damage that he causes when using the rented equipment (art. 1383 and 1384 of the civil code). ABERBIKE will under no circumstances be held liable in the event of damage or loss suffered or caused by the lessee during the use of the rented equipment. Use in competition or for competition-like conduct is prohibited. In the event of damage due to an accident, loss, theft or inappropriate treatment of the equipment, the lessee is responsible for the repair costs. In the event of total damage or loss, the lessee is responsible for the replacement value of the equipment.

9. Security Deposit/Guarantee
The lessor requests a credit card imprint, an identity document or a check as a security deposit against loss, theft or damage to the equipment.

10. Cancellation conditions
For any cancellation occurring at the latest 24 hours before the start of the rental, there is a full refund. For any cancellation less than 24 hours before the start of the rental, the lessee will be reimbursed 50% of the total rental amount.

11. Applicable law
This contract is subject to French legislation. In the event of a dispute, in order to compare the points of view of third parties and allow them to find a solution to the dispute themselves, a mediator may be appointed by the parties or the judge previously seized. This mediation can then take two possible forms: conventional or judicial. In the event of mediation first and non-resolution of the dispute, the competent court by default would be that of the final lessee of the equipment. By agreement or in the case of different tenants and possible victims of damage, a single common court may be determined by the courts.
